Aithical Inc. (“Aithical,” “Aithical.Pro,” “we,” “us,” and “our”) respects your privacy and is committed to protecting it through compliance with this Privacy Policy (“Privacy Policy”). This Privacy Policy describes how we collect and use your Personal Information when you visit our website at https://aithical.pro, when you communicate with us, or when we otherwise process your Personal Information (collectively, the “Platform”).

1. Overview

This Privacy Policy applies to information collected through the Aithical.Pro website and related services we provide as a fractional Chief AI Officer consultancy, including AI strategy engagements, agent builds, visibility and lead generation programs, and discovery conversations initiated through our website forms.

2. Information We Collect About You

Directly from you

When you submit our lead form, book a discovery call, subscribe to a newsletter, or otherwise contact us, we ask for information such as your name, email address, phone number, company, area of interest, and any message you send us. If you submit Personal Information about other people to us, you are responsible for confirming that you have the authority to do so.

From third parties

We may obtain information through marketing partners, advertising and analytics providers, social media platforms, public databases, and event organizers. This can include your name, contact information, professional information, and content that is publicly available.

Automatically when you use our Platform

We collect information about how you interact with the Platform, including device data (such as IP address and browser information), actions taken on the site, and information collected through cookies, pixel tags, and similar technologies. See our Cookies Policy for more.

3. How We Use Information We Collect

We use Personal Information for the following purposes:

  • Functionality and improvement of the Platform. Operating the site, diagnosing problems, providing security, and analyzing usage to improve our services.
  • Client support. Responding to inquiries and providing the consulting, strategy, and AI implementation services you engage us for.
  • Business operations. Accounting, billing, contracts, and compliance with legal and tax obligations.
  • Communications. Sending emails about your inquiry, service updates, security notices, and — where permitted — marketing or educational materials.
  • Protect and secure the Platform. Fraud monitoring, abuse prevention, and cybersecurity.

  • Partners. Co-marketing partners and integration partners where we have a reasonable basis to share.

  • Legal, regulatory, or related purposes. In response to lawful requests, subpoenas, or to protect our rights.

We do not share your phone number or SMS opt-in consent with third parties for their own marketing without your express written consent.

6. Data Retention

We retain Personal Information only for as long as reasonably necessary for the purposes for which we collected it, including to satisfy legal, tax, accounting, or reporting requirements, and for the period of any contemplated dispute. In some cases we may anonymize information and retain it indefinitely for research or statistical purposes.

7. Information From Children

We do not knowingly collect Personal Information from children under 16. If you believe a child has provided us information, please contact us so we can delete it.

8. Links to Other Websites and Services

Our Platform may link to third-party websites and services (including scheduling tools, social networks, and analytics providers). We are not responsible for their privacy practices and recommend reviewing their policies before sharing your information.

9. Do Not Track

Some browsers offer a “Do Not Track” signal. The Platform does not currently respond to DNT signals, but we do honor the Global Privacy Control (GPC) signal where required by law.

Depending on where you live, you may have the right to request access, correction, deletion, or portability of your Personal Information; to object to or restrict processing; to withdraw consent; and to opt out of certain disclosures for advertising. European Privacy Rights (GDPR / UK GDPR / Swiss nFADP)

Aithical is the Data Controller for Personal Information collected through the Platform in the EEA and the UK. You may also lodge a complaint with your local data protection authority — for example, the UK Information Commissioner’s Office at www.ico.org.uk.

U.S. State Privacy Rights

Residents of states including California, Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia may have additional rights, including:

  • Right to opt out of sale, sharing, or targeted advertising. Aithical does not sell your Personal Information for money, but certain disclosures for cross-context advertising may be considered a “sale” or “share” under these laws. You may opt out by emailing us.
  • Right to access, correct, and delete your Personal Information.
  • Right to non-discrimination for exercising your privacy rights.
  • Right to appeal a decision on your request.
  • Authorized agent. You may designate an agent to submit a request on your behalf; we may require verification.

In the past 12 months we have collected the following categories of Personal Information: identifiers (name, email, phone, IP), records described in Cal. Civ. Code §1798.80(e), commercial information, internet/network activity, and inferences. We share these categories with service providers, partners, and advertising/analytics providers as described above. We do not engage in solely automated decision-making that produces legal or similarly significant effects.

Australian Privacy Rights

Australian residents may request access to or correction of their Personal Information under the Privacy Act. We will respond within 30 days. Complaints may be raised with the Office of the Australian Information Commissioner at www.oaic.gov.au.

Canadian Privacy Rights

Canadian residents may request access to and correction of their Personal Information under PIPEDA, and may withdraw consent at any time subject to legal or contractual restrictions. Residents of Quebec may have additional rights similar to those under European law.

11. International Data Transfers

Aithical is based in the United States. Your Personal Information may be transferred to and processed in the United States or other countries where we or our service providers operate. Where required, we use appropriate safeguards such as Standard Contractual Clauses for transfers from the EEA, UK, or Switzerland.

12. Privacy Policy Updates

We may update this Privacy Policy from time to time at our discretion. We will revise the “Last Updated” date and, where required by law, provide additional notice. Your continued use of the Platform after changes are posted constitutes acceptance of those changes.
